The Consumer Product Safety Act and Commission
The Consumer Product Safety Act (CPSA) was passed and put into action in 1972. This Act allows the United Stated Consumer Product Safety Commission (CPSC) to function as an independent agency and to dictate the safety procedures that companies should follow in distribution and services. In Los Angeles the Consumer Product Safety Act is applicable to Roller Coasters and Amusement Park Rides. This act was enabled in hopes to protect the rights and safety of consumers as well as reduce the risks of any injuries or death. Unfortunately the act was amended in 1981 and something called the “Roller Coaster Loophole” now hinders the full ability of the Consumer Products Safety Commission to properly investigate products such as Roller Coasters.
What is the “Roller Coaster Loophole?”
The “Roller Coaster Loophole” is a phrase used to describe the words use in the amendment to the Consumer Product Safety Act which prohibits the safety experts of the federal government from looking into or investigating any kind of roller coaster accident at Amusement Parks. The “Roller Coaster Loophole” is only applicable to fixed-site rides.
A fixed-site ride is any ride at an Amusement Park which is permanently attached to the ground in some way. Therefore any ride found at a Carnival for example would be eligible for safety investigation by the Commission. Federal regulations only cover the mobile rides and attraction, not the fixed-site Amusement Park Rides. Although some states do not have regulation and inspections for fixed-site rides California is among those states that do allow Federal Safety Investigations for immobile Amusement Park Rides.
